1. Acceptance of Terms

By placing an order, accessing our website, or using our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not use our website or services.

These Terms constitute a legally binding agreement between you (the “Customer”) and MicroFridge by Danby (“we,” “us,” or “our”). These Terms apply to all users in all states where we operate.

2. Rental Agreement

2.1 Rental Term

  • Rentals are for a fixed term aligned with the academic year, as specified at the time of order.
  • The rental term begins on the confirmed delivery date and ends on the agreed pickup date.
  • Extensions beyond the original rental term must be requested in writing and are subject to availability and additional fees.

2.2 Order Confirmation

  • By completing your order, you accept these Terms and Conditions in full.
  • You must be at least 18 years of age to enter into a rental agreement.

3. Cancellations & Refunds

  • Orders cancelled prior to delivery are issued a full refund.
  • Orders cancelled during the delivery period are subject to a $50 cancellation and restocking fee.
  • All fees such as damage insurance and cleaning are non-refundable once the unit has been delivered.
  • Refunds, where applicable, will be processed within 10 business days to the original payment method.

4. Delivery & Pickup

  • Delivery and pickup dates will be confirmed by the school after order placement.
  • Failed deliveries due to customer unavailability may incur a redelivery fee.
  • Customer is responsible for moving the unit if a room change occurs after delivery.
  • We are not liable for damage resulting from a customer-initiated move.

5. Condition, Care & Damages

  • Customer is responsible for any damage beyond normal wear and tear during the rental period.
  • Damage charges will be assessed at the end of the rental term and billed to the payment method on file.
  • Customer must not modify, paint, or permanently alter any rented item.
  • Lost or stolen items will be charged at full replacement cost.

6. Payment Terms

  • All payments are processed online via credit card at the time of order.
  •  Prices are listed in US Dollars (USD).
  • We use secure third-party payment processors. We do not store your full card details.
  • Chargebacks initiated without first contacting us may result in suspension of service and additional fees.
  • Outstanding balances not resolved within 30 days may be referred to a collection’s agency.

7. Insurance & Liability

  • An optional insurance fee may be offered at checkout. This fee is non-refundable once the unit has been delivered.
  • Insurance, where purchased, covers accidental damage only. It does not cover theft, intentional damage, or loss.
  • We are not liable for any indirect, incidental, or consequential damages arising from use of our products.
  • Our total liability to you shall not exceed the total amount paid by you for your rental.

8. Prohibited Use

You agree not to use our website or services to:

  • Provide false or misleading information during the ordering process.
  • Use rented items for commercial purposes or sublease them to third parties.
  • Tamper with, disassemble, or attempt to repair any rented item.
  • Engage in any activity that violates applicable federal, state, or local laws.

9. Privacy Policy

Your use of this website involves the collection of personal information including your name, email, and payment details. Our full Privacy Policy governs how we collect, use, store, and protect your data.

10. Intellectual Property

  • All content on this website, including text, images, logos, and graphics, is owned by Interion Corporation and protected by applicable copyright and trademark laws.

  • We reserve the right to update or modify these Terms at any time without prior notice.
  • Changes are effective immediately upon posting to the website.
